The problem

What breaks without it

You almost certainly did not install these tags yourself.

Most healthcare websites run the same tracking tools as every other business: the Meta Pixel, Google Analytics, the Google Ads tag, a chat widget, a form builder. On an ordinary site that is fine. On a treatment center's, a memory-care community's or a fertility clinic's site, those tools can capture which page a visitor viewed, what they typed and where they came from, and send it to Meta or Google tied to that visitor's identity. When the visitor is a prospective patient, identity plus health context can constitute protected health information, and sending it to an ad platform without a business associate agreement can violate HIPAA. You almost certainly did not install these tags yourself. An agency or a developer did, and the risk stayed with you.

The ceiling is high. Statutory maximums reach $73,011 per violation in the most serious tier, where each affected record or day of noncompliance can count separately, and $2,190,294 per violation category per year (HHS, 2026), before state attorney general actions or litigation. Those are maximums, not typical outcomes; penalties depend on culpability, harm and enforcement discretion. The rules are also unsettled in a way that punishes guessing. In June 2024 a federal court vacated the part of HHS's tracking guidance that treated an IP address plus a visit to an unauthenticated health page as protected information; HHS withdrew its appeal in August 2024, OCR says it is evaluating its next steps, and its position on authenticated pages, patient portals and apps — a business associate agreement required, no disclosure without authorization — stands (HHS OCR; Quarles, 2024).
